For what purposes do we store your data?

The Bodybuilder Portal serves to gather information relating to the bodybuilder industry. The aim is to improve the mutual exchange of information as well as the handling process (procurement and execution of orders). To this end, and in order to be able to support bodybuilders worldwide we, Daimler Truck AG, share responsibility for handling your data.

The data provided by you during the registration process and the updating of the corporate unit for the following purposes:

  • to facilitate contact by authorised personnel from Daimler Truck AG in relation to requested quotations and contractual agreements,
  • to allow processing as part of the procurement and execution of orders,
  • for the creation and issue of certificates of non-objection in relation to conversion work,
  • to allow the checking and approval of single-invoice transactions
  • for the operation of whistleblower systems as part of Compliance programmes.
  • subject to your contractual agreement in the context of partnership models, in order to recommend your company to our sales and retail organisation.
  • In isolated cases, your contact details may also be communicated via marketing platforms to end customers in connection with these cooperation models. This is indicated separately as applicable.
  • In order to continue expanding our range of products and services and to pursue the ongoing development of the Bodybuilder Portal and its related systems, we require information on user behaviour and user feedback in the course of market research analyses. In the course of these market research analyses, service providers in the areas of processing and usage receive contact data which you have submitted in order to contact you in connection with market research surveys.
  • We also wish to inform you about new products, our services and events. To this end we use your data, and in particular your email address, to send out newsletters, Bodybuilder Information bulletins or invitations related to trade shows and events. Dispatch by e-mail takes place only with your consent, which you can revoke at any time with effect for the future. You are entitled to revoke at any time consent which you have granted to us. Any such withdrawal of consent shall not affect the legality of data processing carried out in the past on the basis of your consent. Who are the recipients of the data?

We transfer your personal data to the following recipient categories for the purposes mentioned above:

  • Employees of Daimler Truck AG as well as legally independent subsidiaries and branches, often also referred to as third parties (Mercedes-Benz AG and subsidiaries), In the context of bodybuilder support
  • Contractual parties not affiliated with Daimler Truck AG in the context of order acquisition and completion processes as well as queries
  • External service providers and agencies in the context of invitation management for trade fairs and events
  • Postal service providers, freight forwarders and shipping service providers
  • Service providers and test organizations in the context of market research analyses
  • IT service providers in the context of the conservation and software maintenance of the bodybuilder portal and related applications
  • Service providers for credit checks, payments collection and dialog marketing
  • End customers in the context of marketing collaborations for joint product solutions


How is the shared responsibility regulated?

As outlined above, we accept shared responsibility for the processing of your data in accordance with Article 26 GDPR. A joint agreement defines the specific nature and form of our collaboration in a transparent manner. The key content of this agreement can of course be made available to you upon request. Please use the contact data provided below for this purpose.

Where are the data stored?

Your data will be stored and processed centrally in the Daimler Truck AG data center located in Germany.
Data will not be not transmitted to countries in which there is no adequate level of data protection.

For how long do we store the data?

We store your data for as long as is necessary for the given purpose, for example:

  • quotation data: 1 year,
  • contract documents: 10 years,
  • legal matters: 6 years (Section 50, German federal lawyers' act (BRAO)),
  • Warranty and goodwill: 35 years


Where certain data which are processed in connection with sales contracts are subject to a statutory retention period under fiscal law (sales record data), the storage period is 6 or 10 years. Processing of the data is restricted during this period. The statutory retention period begins at the end of the calendar year in which the quotation was submitted or the contract was fulfilled.

Upon persons leaving the company, their personal data should be erased by the bodybuilder's administrator.
Personal data of persons who are no longer active shall be erased after one year.

What rights do you have?

You have the following rights in connection with the processing of your personal data. These rights may be restricted under the applicable national data protection law, however:

  • In accordance with Art. 15 GDPR, you have the right to obtain information about personal data which are stored by our company. This means that you are entitled to require confirmation from us as to whether personal data relating to you undergo processing or not and, if so, you are entitled to information about these personal data. The right of access includes the entitlement to information on the purposes of processing, the categories of personal data which are processed and the recipients or categories of recipients to whom the personal data are or have been disclosed. This right does not apply without qualification, however, as the rights of other persons may restrict your right of access.
  • In accordance with Art. 16 GDPR, you are entitled to have inaccurate data rectified. This means that you can require us to rectify any incorrect personal data relating to your person. With due regard to the purposes of processing, you have the right to require incomplete personal data to be completed, including by means of a supplementary statement.
  • In accordance with Art. 17 GDPR, you have the right to request the erasure of personal data relating to you. This means that when certain conditions apply you are entitled to require us to erase personal data relating to you and that we are obliged to erase personal data.
  • In accordance with Art. 18 GDPR, you have the right to require the processing of your personal data to be restricted. This means that in this case the relevant data shall be tagged and processed by us for certain purposes only (e.g. with your consent or in order to assert legal claims).
  • In accordance with Art. 20 GDPR, when certain conditions apply you have the right to receive personal data relating to you which you have provided to us in a structured, commonly used and machine-readable format and you have the right to transmit such data to another controller without hindrance from us.
  • If you have granted us consent to the processing of your data, you can revoke this consent at any time with effect for the future. Any such revocation will not affect the legality of processing which has taken place on the basis of the granted consent up to the time of revocation.
  • You also have the right to refer to the competent data protection supervisory authority, in particular in the EU member state in which you have your habitual place of residence or in which a violation of the GDPR has allegedly occurred.

When certain conditions apply, on grounds arising from your particular situation or where personal data are used for the purpose of direct marketing you have the right to object to our processing of your personal data at any time and we may be obliged to cease processing your personal data.

Where personal data are used for the purposes of direct marketing, you additionally have the right to object to the processing of personal data relating to you for such purposes at any time. This also applies to profiling in connection with such direct marketing. In this case, we shall no longer process the personal data for these purposes.

What is the procedure for revoking consent?

You are entitled to withdraw any consent which you have granted to us at any time. Any such withdrawal of consent shall not affect the legality of data processing carried out in the past on the basis of your consent. If you wish to exercise your right of withdrawal you can send an email to bbportal@daimlertruck.com.

You can revoke the receipt of newsletters and Bodybuilder Information bulletins at any time under "Company data" > "Privacy Statement".

Is there a right of complaint?

If you are of the view that we are violating the General Data Protection Regulation in processing personal data relating to you, you have the right to file a complaint with the supervisory authority.

Are you obliged to provide these data?

Registration in the Bodybuilder Portal is voluntary. We provide you with the portal as an information platform for your body and conversion solutions on chassis of Daimler Truck AG.

If you fail to provide us with personal details such as surname, first name, telephone number or email for the purposes of registering in the Bodybuilder Portal, registration will not be possible, as we require these data to verify your registration. The process for establishing contact in connection with requests for quotations or technical queries would also be rendered impossible.

How are decisions made (profiling)?

For the purposes of the registration process on the Bodybuilder Portal we refer to the details submitted in the course of the registration process (company name, company website) to assess the companies or individuals concerned for assignment to the relevant user group and subsequent activation.

The data privacy statement has to be updated from time to time to reflect actual circumstances and the prevailing legal situation.
